Requirements for DMCA Notice

  3. Identification of Copyrighted Work: A clear and precise identification of the copyrighted work that you believe has been infringed, in a form that allows us to verify the claim.
  4. Contact Information: Your contact information, including your physical address, telephone number, and email address (if available), so we can reach you regarding your complaint.
  5. Good Faith Statement: A statement affirming that you believe in good faith that the use of the material in question is unauthorized by the copyright owner, its agent, or the law.
  6. Accuracy Statement: A declaration that the information provided in the notification is accurate and that you are authorized to act on behalf of the copyright owner.

Please be aware that under the DMCA, anyone who knowingly and materially misrepresents that material or activity is infringing may be subject to liability.

Investigating Allegations

Upon receiving a valid DMCA notification, we will promptly investigate the matter. If we determine that the complaint is valid, we will remove or disable access to the allegedly infringing material. Additionally, we will notify the third party who posted the content in question and provide them with the opportunity to respond.

Policy on Repeat Offenders

In accordance with the DMCA, we reserve the right to suspend or terminate the access of users who are found to be repeat infringers of copyright. This policy is enforced at our discretion.

Challenging Your Claim

Indemnification

If you willfully misrepresent that material or activity infringes on copyright, you may be liable for damages and must indemnify FinCrack (including costs and attorneys' fees) for any losses incurred.
